Terms of Sale

These terms apply when you create an account, place an order, make an offer or bid at hobbyinvestors.ca (the “store”), operated by Hobby Investors in New Brunswick, Canada (“we”, “us”). By using the store, you agree to them.

1. Your account

You need an account to buy, make offers or bid. You must give accurate details, confirm your email address, and keep your password private. You are responsible for activity on your account. We may suspend accounts used for fraud, abuse, or repeated non-payment.

2. Prices and payment

Prices are in Canadian dollars. Payment is taken at checkout through our payment processor, Stripe; we never see or store your full card number. If an item is listed at an obviously incorrect price, we may cancel the order before it is accepted (see section 3) and refund you in full.

3. When your order becomes binding

Placing an order is an offer to buy the items in it. After payment, we send an order confirmation by email. That email only confirms that we received your order and payment. It is not our acceptance of your order.

Your order is accepted, and a binding contract of sale is formed, only when we send a shipment confirmation to the Messages section of your account on the store. The contract covers only the items listed in that shipment confirmation.

Until then, we may decline or cancel all or part of an order, for example if an item turns out to be unavailable, damaged or mispriced. If we do, we will refund the full amount you paid for the cancelled items to your original payment method.

4. Best offers

On listings that accept offers, you may propose a price. We may accept, decline or counter it. If we accept (or you accept our counter-offer), you must complete payment within 48 hours; after that, the agreed price may expire and the item may be sold to someone else. As with any order, the sale becomes binding only when we send a shipment confirmation (section 3).

5. Auctions

  • A bid is a commitment to buy the item at that price if you win.
  • A bid placed in the last 2 minutes extends the auction so that 2 minutes remain, giving other bidders a fair chance to respond.
  • The winner must pay within 48 hours of the auction ending. If they don't, we may cancel the win, offer the item to another bidder or relist it, and suspend the winner's ability to bid.
  • As with any order, the sale becomes binding only when we send a shipment confirmation (section 3).

6. Item descriptions and condition

We describe and photograph each item carefully. Condition notes are our honest assessment; the photos form part of the description. Colours and finishes may look slightly different on your screen.

7. Shipping

We ship to Canada and the United States, free of charge. Delivery times are estimates. Buyers outside Canada are responsible for any import duties or taxes charged by their country.

8. All sales final

Because of the nature of collectibles, all sales are final and we do not accept returns, except when:

  • an item is lost or damaged in transit, or
  • the item you receive is materially different from its description.

In those cases, message us from your account within 7 days of delivery (or of the expected delivery date, for lost parcels), with photos where relevant. We may ask you to return the item. Once the issue is confirmed, we will offer a replacement where possible, or a refund. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

9. How we communicate

Order and support communication takes place in the Messages section of your account. Emails we send come from an unmonitored address and only notify you; replies to them are not received. To reach us, use your account Messages or our contact page.

10. Liability

To the extent permitted by law, our total liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential losses. This does not limit liability that cannot be limited by law.

11. Governing law

These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there.

12. Changes

We may update these terms from time to time. The version in effect when you place an order applies to that order. See also our Privacy Policy.
